Div A, Tit 2, part 5: A new agency

Subtitle E – governance. It is entirely about setting up the new administration. You’ve noticed the word “commissioner” before? Here’s where that comes into play.

The act creates the Health Choice Administration. You can save yourself a lot of time by realizing it’s extremely similar to the Social Security Administration or Government Services Administration or, well, a lot of other independent agencies – agencies that are bossed by someone who answers directly to the president (but who are not, for the most part, cabinet officers). This agency will be what runs the health care system (excluding Medicare/Medicaid, VA, and other existing systems unless they’re otherwise worked in – and we’ll get to those down the road.)

If you read this in detail you’ll probably get annoyed at the amount of power in this agency. That said I’m not going to dig into it as it’s darn near boilerplate – there’s nothing I see on first read that’s an extreme variation from the powers and responsibilities other administrations have. Oh – no arrest authority, but there is some investigative and civil remedy authority. Again, like most other agencies.
